Addition of Disclaimer ¡V Liability for Damage,
Injury or Death in the paper ULD Release Form (URF) and future electronic URF,
with effect from
During the previous CLG meetings, it was reported that
an accident happened with an empty ULD container dropped from a truck and fell
into the sea when the truck passed through Tsing-Ma bridge. The air carriers expressed concerns on the possible
liability arising from the incident since the container is owned by carrier. As
such, CLG has resolved to develop a disclaimer clause ¡§Disclaimer - Liability
for Damage, Injury or Death¡¨ for release of empty ULDs. Both Cargo Terminal Operators (Hactl and AAT) will use the ULD release form (URF) with the
additional disclaimer starting from

Members (or Members please remind your sub-contractors) that road safety will
be the responsibility of the truck driver. As stated in ¡§Road Safety¡¨
requirement issued by Transport Department (http://www.td.gov.hk/en/road_safety/road_users_code/index/chapter_6_for_professional_drivers/loads_/index.html), when carrying loads, the driver must properly
secure it and make sure that the vehicle, or trailer, is loaded so as not to
cause danger to the driver, or passengers or other road users, or to cause
damage to the road or property.
